This means that it is becoming increasingly difficult for the CLARITY Act to be scheduled before lawmakers leave Washington. At the current pace, the chances of the bill reaching a final Senate vote before next week are slim.

The SEC stated that legislation remains a more solid foundation.

U.S. Securities and Exchange Commission Chairman Paul Atkins said he remains optimistic that Congress will pass the CLARITY Act, calling the legislation the best way to provide long-term regulatory clarity for the crypto industry.

He stated that if the bill becomes law, the SEC is prepared to develop implementing rules based on it; if Congress fails to advance it, the SEC can also take its own regulatory measures for similar crypto market issues. However, he also emphasized that clear written law from Congress remains a more solid foundation.

Trump can recall the Senate during the recess.

Legal analyst MetaLawMan noted that, based on Article II, Section 3 of the Constitution, US President Trump could theoretically request the Senate to reconvene during the August recess, thereby providing a vote on bills such as the Clarity Act.

However, even if the president can recall the Senate, he cannot force senators to pass the bill. More realistically, if the Senate fails to advance the bill before the recess, it will have to wait until Congress reconvenes in September to continue processing it. Even if the Senate passes it, the bill still needs to pass the House of Representatives before it can be sent to Trump for his signature.

Direct impact on the crypto industry

This delay has compressed one of the most closely watched legislative windows in the crypto industry. If no substantial progress is made before the August recess, the bill's future progress this year could be further hampered by election-related agendas and a packed legislative schedule.

Before broader market structure legislation is implemented, the industry will continue to rely more on the progress of stablecoin-related legislation in the short term, while remaining under the existing regulatory framework of the SEC and CFTC.
